Software License Agreement

Single Copy Software License

The software on the Olympus Microscopy Resource Center website is copyrighted and any unauthorized use of this software may violate copyright, trademark, and other laws. You may download one copy of each software product found on this website on a single computer for your personal, non-commercial internal use only, unless specifically licensed to do otherwise by The Florida State University (FSU) and Olympus America, Inc. (Olympus) in writing or as allowed by any license terms which accompany or are provided with individual software packages. This is a license, not a transfer of title, and is subject to the following restrictions: you may not: (a) modify the software or use it for any commercial purpose, or any public display, performance, sale or rental; (b) decompile, reverse engineer, or disassemble software except and only to the extent permitted by applicable law; (c) remove any copyright or other proprietary notices from the software; (d) transfer the software to another person. You agree to prevent any unauthorized copying of the software.

The act of downloading any software from this website constitutes an agreement to these terms. If you do not agree to the terms, do not download any software from our servers.

Ownership of Software

Software is copyrighted and protected by worldwide copyright laws and treaty provisions. Individual software may not be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any way, without the prior written permission of both FSU and Olympus. Except as expressly provided herein, FSU, Olympus and their suppliers do not grant any express or implied right to you under any patents, copyrights, trademarks, or trade secret information. Other rights may be granted to you by FSU and Olympus in writing or incorporated elsewhere in the software.

Termination of License

FSU and/or Olympus may terminate this license at any time if you are in breach of the terms of this License Agreement. Upon termination, you will immediately destroy the software.

Disclaimer: THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF INTELLECTUAL PROPERTY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL FSU OR OLYMPUS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE MATERIALS, EVEN IF FSU AND OLYMPUS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Warning

Because there are inherent dangers in installation and use of any software available for downloading over the Internet, FSU and Olympus caution you to make certain you completely understand the potential risks before downloading software from the Olympus website. You are solely responsible for adequate protection and backup of the data and equipment used in connection with any of the software, and FSU and/or Olympus will not be liable for any damages that you may suffer in connection with using, modifying, or distributing any of this software.

Export

The software is subject to United States export control laws and may be subject to export or import regulations in other countries. You are responsible for strict compliance with such laws and regulations in connection with any software that you download and for obtaining any licenses or permits required to export, re-export or import such software.
